GARAGE FLEX, LLC – RESIDENTIAL FLOOR COATING AGREEMENT LIFETIME PROTECTION WARRANTY

For customers who purchase either (1) the Moisture Vapor Barrier primer option, or (2) the Stone Series flake package combined with the additional polyaspartic top coat, Garage Flex, LLC provides a Lifetime Protection Warranty covering the installed floor coating system against peeling, chipping, delamination, and UV related discoloration for as long as the original purchaser owns the home where the coating was installed. This Lifetime Warranty applies to structural coating performance only.

This Lifetime Warranty applies exclusively to coating systems installed on interior concrete surfaces. Workmanship is warranted for one (1) year from substantial completion. If a warranty covered defect occurs, Garage Flex will, at its sole discretion, repair or replace the affected area at no charge to the Owner. Warranty repairs do not extend, restart, or modify the original warranty term. This warranty represents the sole and exclusive remedy, and no other warranties express or implied apply.

ELIGIBILITY REQUIREMENTS

This Lifetime Warranty applies only when one of the following upgrade options is included in the project:

  • A Moisture Vapor Barrier (MVB) primer, or
  • The Stone Series flake system combined with the professional grade second coat of polyaspartic topcoat.

COVERAGE LIMITATIONS

This Lifetime Warranty covers structural coating failures only, including peeling, chipping, delamination, or UV related discoloration. It does not cover normal wear, cosmetic changes, gloss reduction, abrasion, staining, or any exclusions listed in the standard warranty.

TRANSFERABILITY

This Lifetime Warranty may be transferred one (1) time to a subsequent homeowner for the remaining warranty term if the new homeowner requests a transfer in writing within 30 days of closing. Garage Flex reserves the right to verify installation records before approving a warranty transfer.

WARRANTY EXCLUSIONS

This warranty does not cover damage, failure, or defects resulting from:

  • Improper maintenance, neglect, or the use of unapproved cleaners
  • Misuse or abuse, including impact damage, gouging, or dragging heavy objects
  • Structural movement, including cracking, heaving, settling, or shifting of the concrete slab
  • Moisture vapor transmission, hydrostatic pressure, or water intrusion of any kind
  • Chemical exposure such as battery acid, brake cleaner, industrial solvents, or other harsh chemicals
    Normal wear, traffic patterns, minor cosmetic changes, fading, scuffing, or gloss reduction over time
  • Coatings applied to non concrete surfaces
  • Standing water, slab sweating, or moisture related conditions
  • Damage caused by weather events, Acts of God, or other causes beyond contractor control
  • Any modification or repair performed by parties other than Garage Flex

OWNER RESPONSIBILITIES

Coverage under this warranty requires the Owner to:

  • Follow Garage Flex’s written care and maintenance guidelines
  • Clean spills promptly especially oils, chemicals, and automotive fluids
  • Avoid dragging appliances, tools, or heavy equipment across the surface
  • Notify Garage Flex in writing within 30 days of discovering a potential issue
  • Provide reasonable access for inspection and or repair
  • Maintain all payments and the customer account in good standing
  • Ensure the garage environment remains dry and free from standing water

CONCRETE CRACK & SURFACE REPAIR

Garage Flex will repair visible cracks, saw cuts, pits, and surface imperfections using a professional grade structural repair compound. These repairs are intended to improve surface stability and appearance; however, repaired areas may remain visible in texture or color. Concrete is naturally subject to movement. Future cracking, displacement, or the reappearance of repaired cracks caused by slab movement, settling, or shifting is outside the contractor’s control and is not covered under warranty. Cosmetic hairline cracks may develop over time and do not affect the coating’s performance or adhesion. Low areas (birdbaths) may be improved but are not guaranteed to be eliminated or fully leveled, and minor variations in surface profile may remain after installation.

MOISTURE DISCLOSURE

Concrete naturally retains and transmits moisture. If elevated moisture levels are detected before or during installation, a moisture mitigating primer or sealer may be required at an additional cost. If the Customer declines moisture mitigation, the standard warranty is void for any areas affected by moisture. Moisture conditions including moisture vapor transmission (MVT), hydrostatic pressure, seasonal vapor drive, slab sweating, condensation, or water intrusion from external sources are outside the control of Garage Flex and are not covered by any warranty. These conditions may result in bubbling, discoloration, blistering, or delamination of the coating. Moisture levels can fluctuate over time due to weather, drainage, groundwater, and environmental conditions. Moisture testing provides a snapshot in time and does not guarantee future conditions. The installation of an MVB primer does not create a moisture related warranty.

TEXTURE & SLIP RESISTANCE

All floor surfaces can become slippery, especially when wet or contaminated with snow, ice melt, oils, or debris. While optional slip resistant texture can improve traction, no coating or surface treatment can eliminate slip risk. The Customer acknowledges and accepts responsibility for the safe use, maintenance, and monitoring of the finished floor, including keeping the surface clean and dry. Garage Flex is not liable for slips, falls, or injuries occurring on the coated surface.

SURFACE CONDITIONS & SUBSTRATE LIMITATIONS

Garage Flex does not provide concrete leveling and does not guarantee the elimination of existing waves, dips, low areas, birdbaths, high spots, or slab slope variations. The final coated surface will generally follow the existing profile and condition of the underlying concrete. Repairs, patchwork, and surface corrections are intended to improve performance, but may remain visible in texture, contour, or color after coating. Coating systems do not conceal substrate imperfections. Vertical surfaces including stem walls, steps, risers, foundations, and thresholds are coated for decorative purposes only. These areas may exhibit visible texture, variation, or imperfections due to their construction and are not expected to match the finish quality of the main floor.

COLORS & FINISH

The Customer is responsible for selecting all colors, flake blends, and finish options. The standard finish is Gloss unless otherwise specified in writing. Due to natural variations in flake blends, pigments, concrete surface texture, and lighting conditions, the final appearance may differ slightly from samples, photographs, or digital renderings. Such variations are normal and are not considered defects. Once the Customer approves a color or finish selection, any changes may result in additional charges, material restocking fees, or scheduling delays. Changes requested after installation cannot be accommodated.

PROJECT SCHEDULING

All start dates and completion timelines are estimates only and may change based on weather conditions, material availability, moisture levels, surface conditions, or other factors outside the control of Garage Flex. Coating installations are weather sensitive, and delays may occur due to temperature, humidity, rain, or a wet slab. The Customer is responsible for ensuring the work area is fully accessible and ready for installation. Delays caused by incomplete clearing of the garage, restricted access, wet surfaces, unexpected repairs, or site conditions discovered during prep may impact the schedule. Garage Flex is not liable for any costs or damages resulting from scheduling changes, delays, or extended project timelines.

CUSTOMER RESPONSIBILITIES PRIOR TO INSTALLATION

To ensure a successful installation, the Customer agrees to:

  • Remove all items from the garage, including vehicles, tools, storage items, appliances, and loose materials. Garage Flex does not move appliances, large equipment, or fixed installed items
  • Ensure the workspace is clean, dry, and accessible, with no standing water, slab sweating, or moisture on the surface
  • Protect or remove nearby items from dust settlement, including vehicles, shelving, wall mounted items, and personal belongings
  • Ensure access to the garage is available at the scheduled start time (doors unlocked, vehicles moved)
  • Keep pets, children, and household members clear of the work area for safety
  • Notify Garage Flex in advance of any drainage issues, moisture concerns, or site conditions

Failure to meet the above requirements may result in delays, rescheduling, or additional charges for labor, return trips, or downtime.

RETURN TO USE TIMELINE

Proper cure time is essential for long term performance. The Customer agrees to follow the use restrictions below:

  • 12 hours: Light foot traffic only
  • 24 hours: Return lightweight items (chairs, storage bins, etc.)
  • 48 hours: Vehicle traffic, heavy items, and full use permitted

Cure times may vary based on temperature, humidity, and ventilation. Cooler conditions may extend the timeline. Damage caused by premature use, including driving, placing heavy items, turning tires, sliding appliances, or exposing the coating to water before it has fully cured, is not covered under any warranty.

CHANGE ORDERS

All modifications to the scope of work including but not limited to additional repairs, changes in materials, color or finish adjustments, or expanded services must be documented in a written Change Order signed by the Customer. Garage Flex shall have no obligation to perform additional or revised work without an approved Change Order. Change Orders may increase the contract price and may extend the project schedule. Verbal instructions or informal requests are not valid or enforceable.

PAYMENT TERMS & AUTHORIZATION

A 50% deposit is required before the project can be scheduled. The remaining 50% balance is due upon job completion unless otherwise agreed in writing. Any unpaid balance will accrue 2% interest per month until paid in full. The Customer authorizes Garage Flex to securely retain the payment method used for the deposit and to process the final balance upon job completion. If the Customer or their representative is not present at completion, the final payment will still be processed using the authorized payment method. Failure to make required payments may result in Garage Flex filing a mechanic’s lien against the property pursuant to applicable state law.

MOBILIZATION / WALKAWAY FEE

If Garage Flex arrives on site and is unable to perform the scheduled work due to site conditions beyond our control, a $350 mobilization fee will be charged. This includes, but is not limited to:

  • Work area not fully cleared or accessible
  • Slab moisture, slab sweating, standing water, or wet surfaces
  • Unsafe or obstructed working conditions
  • Customer not present or unable to provide access
  • Interference from pets, vehicles, appliances, or stored items
  • Any site condition discovered that prevents proper preparation or coating

The mobilization fee covers crew labor, travel, and lost scheduling time.

LEGAL TERMS

The Customer may cancel this Agreement within three (3) business days of signing. After this period, all deposits become non refundable. Unpaid balances may result in the filing of a mechanic’s lien in accordance with applicable Missouri and Kansas laws. Any disputes arising from this Agreement shall be resolved through binding arbitration administered in the county where the project was performed. Class actions and class arbitration are expressly prohibited. In no event shall Garage Flex’s liability exceed the total contract price paid by the Customer, and Garage Flex shall not be liable for any incidental, consequential, indirect, or special damages. This Agreement constitutes the entire understanding between the parties and supersedes all prior proposals, estimates, or communications. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

The following notices are required by law in Missouri and Kansas and apply to all residential improvement contracts.

MECHANICS’ LIEN CONSENT & OWNER NOTICES

This section provides legally required notices for projects performed in Missouri and Kansas. The applicable notice(s) shall be determined by the state in which the property is located.

MISSOURI NOTICE (RSMo § 429)

For projects located in the State of Missouri, the Customer acknowledges and consents that, under Missouri’s Mechanics’ Lien Statute (RSMo § 429), Garage Flex, LLC and any subcontractors, laborers, or material suppliers who provide labor, materials, or services for the work described in this Agreement may file a mechanic’s lien against the property if they are not paid in full.

Nothing in this Agreement shall be interpreted as a waiver of Garage Flex’s lien rights unless an authorized representative signs a written lien waiver after payment has been received and cleared.

The Customer understands that the contractor’s failure to pay subcontractors or suppliers may result in a lien being filed. To avoid this possibility, the Customer may request lien waivers from those providing labor or material. Failure to obtain lien waivers may result in the Customer being required to pay for certain labor or materials twice.

KANSAS NOTICE (K.S.A. § 60 1101 et seq.)

For projects located in the State of Kansas, the Customer is hereby notified that under Kansas law, suppliers, subcontractors, or laborers who furnish materials or labor for the work described in this Agreement may file a lien against the property if they are not paid by the contractor.

If the Customer receives a Notice of Intent to Perform Work or a Notice of Filing of Lien Statement from any supplier or subcontractor, the Customer may withhold from the contractor an amount equal to the claim until the dispute is resolved.

The Customer may request lien waivers from all parties supplying materials or services to reduce the risk of lien exposure.

Nothing in this Agreement waives Garage Flex’s lien rights unless expressly waived in writing by an authorized representative after payment has been received and cleared.

THREE DAY RIGHT TO CANCEL (IF SOLICITED AT CUSTOMER’S RESIDENCE)

If this Agreement was solicited at the Customer’s residence, the Customer may cancel this Agreement within three (3) business days of the transaction date by mailing or delivering written notice of cancellation to:

If the Customer cancels within the three day period:

  • all materials must be returned in substantially the same condition
  • Garage Flex will return any payments received within ten (10) days, and
  • if materials are not picked up by Garage Flex within twenty (20) days of cancellation, the Customer may retain or dispose of them without further obligation

This right to cancel applies only when required by applicable state or federal law.

ACKNOWLEDGMENT

The Customer acknowledges receipt of the above notices and understands their rights and obligations under the mechanics’ lien laws of Missouri or Kansas, as applicable. The Customer accepts the terms, pricing, and conditions of this Agreement and authorizes Garage Flex, LLC to perform the work described. Payment shall be made according to the terms provided.

THIS CONTRACT CONTAINS A BINDING ARBITRATION PROVISION THAT MAY BE ENFORCED BY THE PARTIES.
